Terms & Policies

Disclaimer

The products listed are intended primarily for some form of racing or high performance, which implies that they will be pushed to severe and unusual limits. Moran Motorsports has no control over the installation or usage of these items and therefore accepts no responsibility for personal injury or loss of property resulting from their use. Not for highway use.

We furnish the listed name brand parts whenever possible. However, Moran Motorsports reserves the right to substitute equal or better parts from the same or different manufacturer where listed parts are unavailable, or at the discretion of Moran Motorsports, performance will be equal or better than use of the listed part.

Terms

All orders shipped pre-paid. If the payment is to be of an unsecured fund, Moran Motorsports will demand payment 10 days prior to delivery. No products(s) will be released to customer until payment in full is received.

Payments / Deposits

For these orders, payments are accepted by cash or check made payable to Moran Motorsports. A 50% deposit is required to start along with a signed copy of your quote. If the last payment is to be of an unsecured fund, Moran Motorsports will demand payment 10 days prior to delivery. No product will be released to customer until payment in full is received. Check payments – If your check is returned for non-sufficient funds, you expressly authorize your account to be electronically debited or bank drafted for the amount of the check plus any applicable fees. The use of a check for payment is your acknowledgement and acceptance of this policy and its terms and conditions. Check Velocity 800.430.2370 www.checkvelocity.com.

Check Policy

All returned checks will be assessed a $25.00 service charge plus any other fees incurred in the collection of the item. Customers sent to collections will be charged a $50.00 fee minimum or as allowed by law and may be responsible for all fees incurred during the collection. Any unpaid NSF checks will be subject to collection and legal action. Check payments – If your check is returned for non-sufficient funds, you expressly authorize your account to be electronically debited or bank drafted for the amount of the check plus any applicable fees. Shipping

Moran Motorsports will make various shipping arrangements at the best rate possible. Pre-Payment is required. If you would like, you can also make your own shipping arrangements. Please inspect the container and contents closely, saving all the original packaging. If you detect damage to your shipment, make a written note of the damage with the delivery personal because their company is responsible for any and all damages, NOT Moran Motorsports.

Refusals

All refusals will have a $25.00 handling charge and applicable freight charges billed to the customers account.

Drop Ship Orders

Factory drop ship orders will be subject to the manufacturer’s policy and an additional fee may apply. Please contact Moran Motorsports directly.

Special Orders / Custom Parts

All special orders and / or custom parts are subject to freight and handling charges from the manufacturer. No returns accepted on special order and custom parts.

Sales Tax

Sales made in Michigan, or shipped to a Michigan address, are subject sales tax unless the customer has a valid sales tax exemption number for our records at that time.

International

We welcome international orders and can make various shipping arrangements at the best rate possible. We do require pre-payment for these orders.
International Payments / Deposits
International Payments are accepted by wire transfer only. Wire transfer instructions are provided upon request, if needed. We are sorry for any inconvenience.
International Shipping
The customer is responsible for any and all Customs Duty and Taxes. In addition, please see the Shipping section above.

Returns

Returned items on a case by case basis – most sales are final. Please contact Moran Motorsports directly for information about returns. Prior authorization is required. Returned items must be unused and may be subject to a restocking fee. There are no returns on large or custom items. There are no returns on engines.

Pricing

The prices listed are subject to change without notice. Final pricing is determined by additions; expedite fees, additional upgrades, changes, shipping, freight, etc...

Credit Agreements

It is agreed as follows: Buyer agrees with Moran Motorsports, Inc. to pay for all purchases upon receipt of Invoice, Quote, Estimate or Order. Charges billed, but not paid by 30 days from date of invoice will be considered delinquent and subject to finance charges.

The FINANCE CHARGE for individuals is computed by a periodic rate of 1.5% per month which is applied to the "Previous Unpaid Balance less Current Credits." Current credits or payments credits received by 12:00 A.M. on the 30 day of the following month. The minimum payment due will be payment of Buyer's indebtedness in full. If not paid, Moran Motorsports, Inc. may declare the unpaid balance due and payable immediately. Buyer agrees to pay collection expenses, including reasonable attorney's fees and court costs, if it is necessary to collect through legal action.

Buyer assumes full responsibility for all materials purchased from Moran Motorsports, Inc. Buyer agrees to be personally liable for all charges and individually guarantees payment of all charges promptly. Buyer agrees to notify Moran Motorsports, Inc. within 7 days in writing of receipt of invoice. Failure to so notify Moran Motorsports, Inc. signifies total acceptance and responsibility for prompt payment in full of account.

If materials are ordered to be delivered, the buyer assumes liability for the materials at the time of delivery whether or not buyer's representative is on hand to acknowledge receipt of delivery. Buyer agrees to pay standard delivery charges as billed.

Moran Motorsports, Inc. reserves the right to send out "Notice to Owners" and file Liens on past due accounts and use any legal means available to force collection if necessary.

Warranty

Warranty & Legal Statement: The only warranties applying to this part(s) or service are those which may be offered by the manufacturer. The selling dealer hereby expressly disclaims all warranties, either express or implied, including any implied warranties or merchantability or fitness for a particular purpose, and neither assumes nor authorizes any other person to assume for it any liability in connection with the sale of this part(s) and/or service. Buyer shall not be entitled to recover from the selling dealer any consequential damages, damages to property, damages for loss of use, loss of time, loss of profits, or income or any other incidental damages. Due to the nature of their use, racing parts are not covered by warranty once they have been used. No refunds will be given on shipping charges.

Moran Motorsports, Inc. Makes no warranties...
either express or implied, including any warranty of merchantability of or fitness for a particular purpose. There is no warranty expressed or implied as to whether the goods sold hereby will protect purchaser or ultimate user of such goods from injury or death. Racing is a dangerous activity and the user shall determine the suitability and safety of the product for its intended use, and the user assumes all responsibility and risk in connection there within. The purchaser is responsible for determining the suitability of any and all products purchased from Moran Motorsports, Inc. There is no warranty stated or implied due to the unusual stresses places on race cars and components and we have no control over how they are installed, maintained, and used. Due to the hazards involved with racing, Moran Motorsports, Inc. accepts no liability for failures of racing components or accessories manufactured or sold by Moran Motorsports, Inc. or any of its Distributors. Upon purchasing this product(s), customers accept all risks involved with racing and hazards thereof.
